I don't think Elon Musk will win this case against Sam Altman. OpenAI has restructured legally and their argument is that the mission has evolved, not been violated. Courts tend to side with organizational autonomy in restructuring decisions. Musk also left the board voluntarily, which weakens his standing. The legal threshold to prove a binding charitable obligation was broken is very high.
